TERMS AND CONDITIONS OF THE HASH STORE ONLINE SHOP

1. Definitions

The terms used in these Terms and Conditions shall have the following meaning:

Seller – ALA Alicja Broczkowska-Majka, ul. Polna 37, 55-003 Nadolice Małe, Poland, NIP/VAT ID: 7532366610, REGON: 382040928, e-mail address: info@hash-store.com.

Online Shop / Shop – the online store available at www.hash-store.com, through which the Customer may, in particular, place Orders.

Customer – a natural person, legal person or organisational unit without legal personality, which is granted legal capacity by law, placing an Order in the Shop.

Consumer – a Customer who is a natural person and enters into an agreement with the Seller for purposes not directly related to their business or professional activity, in accordance with Article 22¹ of the Polish Civil Code.

Entrepreneur with consumer rights – a natural person entering into an agreement with the Seller directly related to their business activity, where the content of the agreement indicates that it is not of a professional nature for that person, in particular based on the subject of their business activity disclosed in CEIDG.

Goods / Product – a product presented in the Shop, in particular clothing, sportswear, pole dance outfits, training outfits, ready-made products, personalised products, custom-made products and other products available in the Shop’s offer.

Ready-made Product – a Product available in the standard offer of the Shop, not made according to the Customer’s individual specification and not personalised at the Customer’s request.

Personalised / Custom-made Product – a non-prefabricated Product manufactured according to the Customer’s specification or intended to meet the Customer’s individual needs, in particular a Product made to order, made according to the Customer’s measurements, modified at the Customer’s request, made in a colour, size, cut, configuration or fabric selected by the Customer, with individual changes, embellishments, crystals, prints, appliqués or other personalisation.

Sales Agreement – a sales agreement for a Product concluded between the Seller and the Customer through the Shop.

Order – the Customer’s declaration of intent aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of Products.

Terms and Conditions – these Terms and Conditions of the Online Shop.

Civil Code – the Polish Act of 23 April 1964, the Civil Code.

Consumer Rights Act – the Polish Act of 30 May 2014 on consumer rights.

Act on the Provision of Electronic Services – the Polish Act of 18 July 2002 on the provision of electronic services.


2. General provisions

  1. These Terms and Conditions set out the rules for using the Online Shop available at www.hash-store.com.
  2. The Shop is operated by ALA Alicja Broczkowska-Majka, ul. Polna 37, 55-003 Nadolice Małe, Poland, NIP/VAT ID: 7532366610, REGON: 382040928, e-mail address: info@hash-store.com.
  3. These Terms and Conditions specify in particular:
    • the rules for using the Shop;
    • the rules for placing Orders;
    • the rules for concluding Sales Agreements;
    • payment and delivery rules;
    • the rules for withdrawal from the agreement;
    • the rules excluding the right of withdrawal for Personalised and Custom-made Products;
    • complaint procedures;
    • promotion and discount code rules.
  4. To use the Shop, the Customer must have a device with Internet access, an up-to-date web browser supporting JavaScript and cookies, and an active e-mail account.
  5. The Customer may access these Terms and Conditions at any time through a link available in the Shop, and may save or print their content.
  6. The Seller may restrict the provision of services through the Shop to persons who are at least 18 years old, if required by applicable law or by the nature of the Products offered.
  7. The Seller takes measures to ensure the proper and secure operation of the Shop, in particular with regard to the protection of data transmitted through the Shop.

3. Rules for using the Shop

  1. The Customer is obliged to use the Shop in accordance with the law, these Terms and Conditions and good practice.
  2. The Customer is obliged in particular to:
    • refrain from providing unlawful content;
    • refrain from taking actions that disrupt the operation of the Shop;
    • use the Shop in a way that does not infringe the rights of other persons;
    • provide true, current and complete data necessary to process the Order.
  3. It is forbidden to use the Shop to submit content that violates the law, personal rights of third parties, copyrights, industrial property rights or principles of social coexistence.

4. Placing Orders and conclusion of the Sales Agreement

  1. Information about Products provided in the Shop, in particular descriptions, parameters, photos, prices and availability, constitutes an invitation to conclude an agreement within the meaning of Article 71 of the Polish Civil Code.
  2. To place an Order, the Customer selects a Product, adds it to the cart and then follows the instructions displayed in the Shop.
  3. Before placing an Order, the Customer may review and change their data, the contents of the cart, the delivery method and the payment method.
  4. To place an Order, the Customer must provide the data marked as mandatory and click the “Order with obligation to pay” button or another equivalent button clearly informing about the obligation to pay.
  5. Placing an Order by the Customer constitutes an offer to conclude a Sales Agreement with the Seller.
  6. After placing an Order, the Customer receives an e-mail confirming receipt of the Order.
  7. The Sales Agreement is concluded when the Customer receives an e-mail confirming that the Order has been accepted for processing, unless the content of the e-mail states otherwise.
  8. The Sales Agreement is concluded in Polish, and in the case of foreign language versions of the Shop, it may also be concluded in another language made available by the Shop.
  9. The recording, securing and making available of the Order data and these Terms and Conditions takes place via e-mail.
  10. By placing an Order for a Personalised or Custom-made Product, the Customer acknowledges that such Product is made according to their individual specification or intended to meet their individual needs.

5. Custom-made and personalised Products

  1. The Shop offers both Ready-made Products and Personalised or Custom-made Products.
  2. A Personalised or Custom-made Product is, in particular, a Product:
    • made according to the Customer’s individual measurements;
    • made in a colour, size, fabric, cut or configuration selected by the Customer;
    • modified at the Customer’s request;
    • embellished at the Customer’s request;
    • made based on inspiration, a project, description, sketch or arrangements provided by the Customer;
    • containing individual prints, inscriptions, crystals, appliqués or other personalised elements;
    • adapted to the Customer’s individual needs in a way that goes beyond the standard offer of the Shop.
  3. Information that a given Product is custom-made, personalised or is not subject to the standard right of withdrawal may be indicated in the Product description, in the cart, in correspondence with the Customer or in arrangements made before placing the Order.
  4. In the case of Personalised or Custom-made Products, the Seller may begin processing the Order after payment has been credited, or after a deposit or advance payment has been made, if this has been individually agreed with the Customer.
  5. In the case of Products made according to individual arrangements with the Customer, the processing time may depend on the complexity of the project, availability of materials, amount of embellishment, number of Orders currently being processed and the need to make additional arrangements with the Customer.
  6. If the processing of a Personalised Product requires approval of the design, size, colour, fabric, visualisation or other details by the Customer, the processing time may be counted from the moment the Seller receives all necessary information and approval from the Customer.
  7. Personalised and Custom-made Products are not subject to return under the right of withdrawal, because they are made according to the Customer’s specification or intended to meet the Customer’s individual needs.
  8. The exclusion of the right of withdrawal for Personalised and Custom-made Products does not limit the Customer’s right to submit a complaint if the Product is not in conformity with the agreement.

6. Prices, payments, invoices and KSeF

  1. Product prices are displayed in the Shop in Polish zloty, euro, US dollars or other currencies made available in the Shop.
  2. Product prices include taxes, including VAT, if VAT is due under applicable law.
  3. The Product price does not include delivery costs, unless the promotion description, cart or Order summary states otherwise.
  4. The total Order price, including the Product price, delivery costs and any additional costs, is shown to the Customer before the Order is placed.
  5. The Customer may make payment using the payment methods available in the Shop at the time of placing the Order, in particular:
    • bank transfer;
    • payment card;
    • fast electronic transfer;
    • BLIK;
    • PayPal;
    • deferred payment / buy now, pay later;
    • through a payment operator used by the Shop, including IAI Pay / IdoPay;
    • any other payment method made available in the Shop.
  6. Available payment methods may vary depending on the delivery country, Order currency, Order value, payment operator settings or current Shop configuration.
  7. If the Customer chooses payment through an external payment operator, the transaction is carried out in accordance with the rules and terms of that operator.

  10. The Customer may receive a VAT invoice if they provide the data necessary to issue it, in particular name and surname or company name, address and VAT/NIP number if the invoice is to be issued to a business entity.
  11. In the case of sales to business customers, invoices may be issued and made available through the Polish National e-Invoicing System, hereinafter: KSeF, in accordance with applicable law.
  12. Invoices issued through KSeF are made available to the buyer in accordance with the rules of KSeF. The Seller may additionally send the Customer a visual version of the invoice, e.g. in PDF format, to the e-mail address provided in the Order.
  13. In the case of sales to Consumers, an invoice may be issued at the Customer’s request in accordance with applicable law. If an invoice for a Consumer is issued through KSeF, the Seller will make it available to the Customer in an agreed manner, e.g. by e-mail.
  14. Providing data necessary to issue an invoice is voluntary, but necessary in order to issue the invoice.

7. Promotions, discount codes and price reductions

  1. The Shop may organise promotions, provide discount codes, vouchers, free delivery, price reductions or other promotional campaigns.
  2. The rules of a given promotion may be specified in separate promotion terms, a promotional announcement, discount code description or information displayed in the Shop.
  3. The Shop allows different forms of promotions and discount codes to be combined, unless the terms of a specific promotion or promotional announcement state otherwise.
  4. Regardless of the number of promotions or discount codes applied, the total discount granted for one Order may not exceed 30% of the Order value, regardless of the currency in which the Order is placed, unless the terms of a specific promotion expressly state otherwise.
  5. If the use of several promotions or discount codes would exceed the limit specified above, the Shop system may automatically limit the discount value so that it does not exceed 30%.
  6. The Shop reserves the right to exclude the possibility of combining promotions or discount codes as part of a specific promotional campaign.
  7. If the Shop informs about a price reduction for a Product, it also provides the lowest price of that Product from the 30-day period before the reduction was introduced, in accordance with applicable law.
  8. In the case of Products offered for sale for less than 30 days, the information about the lowest price may refer to the period from the date the Product was first offered for sale until the date the price reduction was introduced.
  9. Discount codes, promotions and vouchers cannot be exchanged for cash, unless the terms of a specific promotion state otherwise.
  10. Promotions are valid for the period indicated by the Shop or while stocks last, if such condition has been stated.
  11. The Shop may refuse to apply a discount code or promotion if the code has been used contrary to the terms of the promotion, has been provided to an unauthorised person, has expired or does not meet the conditions specified for the promotion.

8. Delivery and Order processing

  1. Products are delivered within the territory of the Republic of Poland and to selected countries available in the Order form.
  2. Delivery is made to the address indicated by the Customer when placing the Order or to a selected pickup point, if such option is available.
  3. Product delivery may be carried out in particular by:
    • InPost courier;
    • InPost parcel lockers;
    • DPD courier;
    • UPS courier;
    • other carriers available in the Shop at the time of placing the Order.
  4. Delivery costs are shown to the Customer before placing the Order.
  5. The Order processing time is from 1 to 30 business days, unless a different time is indicated for a given Product, in the Order description, in correspondence with the Customer or in the terms of a specific promotion.
  6. The carrier’s delivery time should be added to the Order processing time. Delivery time depends on the selected delivery method and delivery country.
  7. In the case of Custom-made, Personalised, embellished Products or Products requiring individual arrangements, the processing time may be counted from the date of payment crediting, deposit or advance payment, design approval or provision by the Customer of all data necessary to complete the Order.
  8. If several Products with different processing times are ordered, the processing time for the entire Order corresponds to the longest processing time among the ordered Products, unless the parties agree otherwise.
  9. The Seller is not responsible for delays resulting from incorrect or incomplete delivery details provided by the Customer.
  10. In the case of international shipments, the Customer may be required to pay additional customs, tax or import charges if they arise under the laws of the delivery country. These charges are not dependent on the Seller.

9. Right of withdrawal

  1. A Consumer and an Entrepreneur with consumer rights have the right to withdraw from the Sales Agreement within 14 days without giving any reason, subject to the exceptions indicated in these Terms and Conditions and applicable law.
  2. The withdrawal period expires 14 days after the day on which the Customer came into possession of the Product or on which a third party other than the carrier and indicated by the Customer came into possession of the Product.
  3. To exercise the right of withdrawal, the Customer should inform the Seller of their decision by means of a clear statement, for example by e-mail to info@hash-store.com or in writing to:

  4. To meet the withdrawal deadline, it is sufficient for the Customer to send information concerning the exercise of the right of withdrawal before the 14-day period expires.
  5. The Customer should return the Product immediately, no later than 14 days from the day on which they informed the Seller about withdrawal from the agreement.
  6. The deadline is met if the Customer sends the Product back before the 14-day period expires.
  7. The Customer bears the direct costs of returning the Product, unless the Seller agrees to bear them or the terms of a specific promotion state otherwise.
  8. It is recommended to return the Product in a way that protects it against damage during transport. If possible, it is recommended to use the original packaging; however, lack of original packaging does not exclude the right of withdrawal.
  9. The Customer is liable for any reduction in the value of the Product resulting from using it in a way other than necessary to determine the nature, characteristics and functioning of the Product.
  10. The returned Product should be complete. If the Customer received free gifts, accessories or additional items related to the purchase, they should be returned together with the Product.

10. Exclusion of the right of withdrawal for personalised and custom-made Products

  1. The right of withdrawal does not apply to the Consumer and the Entrepreneur with consumer rights in the cases specified in Article 38 of the Polish Consumer Rights Act.
  2. In particular, the right of withdrawal does not apply to non-prefabricated Products manufactured according to the Customer’s specification or intended to meet the Customer’s individual needs.
  3. This means that the following Products are not returnable under the right of withdrawal, in particular:
    • custom-made Products;
    • personalised Products;
    • Products made according to the Customer’s individual measurements;
    • Products made in a colour selected by the Customer;
    • Products made in a size selected by the Customer, if they are not standard ready-made Products available in regular sale;
    • Products made in a fabric, material or configuration selected by the Customer;
    • Products modified at the Customer’s request;
    • Products embellished at the Customer’s request;
    • Products with individually selected crystals, appliqués, straps, mesh, prints, inscriptions or other additions;
    • Products made according to an individual project, inspiration, sketch, description, reference photo or arrangements with the Customer;
    • Products prepared especially for the Customer after prior individual arrangements.
  4. The Customer acknowledges that Personalised and Custom-made Products are made especially for them and are not standard Ready-made Products that can be reintroduced into regular sale without the risk of loss of value, mismatch or loss of the individual nature of the Order.
  5. Information that a given Product is custom-made, personalised or not returnable under the right of withdrawal may be indicated in the Product description, in the cart, in correspondence with the Customer or in arrangements made before placing the Order.
  6. Placing an Order for a Personalised or Custom-made Product means that the Customer accepts that after the Sales Agreement is concluded and the processing of the Order has begun, they do not have the right to withdraw from the agreement with regard to that Product, unless applicable law provides otherwise.
  7. The exclusion of the right of withdrawal does not limit the Customer’s right to submit a complaint if the Product is not in conformity with the agreement.

11. Effects of withdrawal from the agreement

  1. In the event of effective withdrawal from the agreement, the Seller refunds all payments received from the Customer, including the cost of delivery of the Product, except for additional costs resulting from the Customer’s choice of a delivery method other than the cheapest standard delivery method offered by the Shop.
  2. The refund will be made immediately, no later than 14 days from the day on which the Seller was informed of the Customer’s decision to withdraw from the agreement.
  3. The Seller may withhold the refund until the Product is received back or until the Customer provides proof of having returned it, whichever occurs first.
  4. The refund will be made using the same payment method used by the Customer in the original transaction, unless the Customer expressly agrees to another method.
  5. The Customer will not incur any fees in connection with the refund, except for the costs indicated in these Terms and Conditions or resulting from choosing a more expensive delivery method.

12. Product complaints

  1. The Seller is liable towards the Consumer and the Entrepreneur with consumer rights for the lack of conformity of the Product with the agreement, in accordance with the Polish Consumer Rights Act.
  2. The Product is in conformity with the agreement if, in particular, its description, type, quantity, quality, completeness, functionality, suitability for a specific purpose and other characteristics indicated in the Product description or agreed with the Customer are in conformity with the agreement.
  3. If the Product is not in conformity with the agreement, the Customer may submit a complaint and specify their request in accordance with applicable law.
  4. In the first instance, the Customer may request that the Product be brought into conformity with the agreement by repair or replacement.
  5. In cases specified by law, the Customer may request a price reduction or withdraw from the agreement.
  6. A complaint may be submitted by e-mail to info@hash-store.com or in writing to:

  7. In the complaint, it is recommended to provide:
    • the Customer’s name and surname;
    • Order number;
    • contact details;
    • description of the lack of conformity of the Product with the agreement;
    • photos documenting the issue, if they may help to process the complaint;
    • the Customer’s request.
  8. Lack of the above information does not affect the validity of the complaint if it is possible to process the complaint based on the information provided by the Customer.
  9. The Seller will respond to the complaint within 14 days from the date of receipt.
  10. If the complaint is accepted, the Seller will bring the Product into conformity with the agreement, in particular by repair or replacement, or will take other actions provided for by applicable law.
  11. The Customer should make the Product subject to complaint available to the Seller for repair or replacement. The detailed method of handing over the Product will be agreed with the Customer.
  12. The Customer’s rights arising from the lack of conformity of the Product with the agreement are not limited by any guarantee.
  13. Products may be covered by a guarantee only if information about the guarantee is clearly indicated next to the Product or in a separate guarantee document.
  14. Lack of guarantee does not exclude or limit the Customer’s rights arising from the provisions on lack of conformity of the Product with the agreement.

13. Complaints concerning the operation of the Shop and electronic services

  1. The Seller takes measures to ensure the proper operation of the Shop.
  2. Irregularities related to the functioning of the Shop may be reported by e-mail to info@hash-store.com or in writing to:

  3. In the report, it is recommended to describe the type and date of the irregularity.
  4. The Seller will respond to a complaint concerning the operation of the Shop within 14 days from the date of receipt.

14. Product safety

  1. The Seller offers Products intended to be used in accordance with their purpose, description, instructions, markings and information provided to the Customer.
  2. The Customer should use the Products in accordance with their purpose, in particular taking into account information concerning care, washing, drying, storage and use.
  3. In the case of sportswear, training outfits, pole dance outfits, gymnastics outfits or Products embellished with crystals, appliqués, mesh, straps or other delicate elements, the Customer should take particular care when using, putting on, taking off, washing and storing the Product.
  4. Products containing decorative elements, crystals, appliqués or small parts are not intended for small children, unless the Product description clearly states otherwise.
  5. Information concerning product safety, care, composition, use or specific warnings may be provided in the Product description, on the label, in instructions attached to the Product, in correspondence with the Customer or in another place made available by the Seller.
  6. The Customer should read the information concerning care and use of the Product before using it.
  7. Failure to follow recommendations concerning use, washing, drying, storage or care may result in damage to the Product, for which the Seller is not responsible if the damage results from improper use by the Customer.

15. Personal data

  1. The controller of Customers’ personal data is the Seller.
  2. Customers’ personal data are processed for the purpose of handling Orders, performing Sales Agreements, processing payments, delivery, complaints, returns, issuing invoices, contacting the Customer and fulfilling legal obligations imposed on the Seller.
  3. Detailed rules for the processing of personal data are set out in the Privacy Policy available in the Shop.
  4. In the case of issuing invoices, the Customer’s data may be processed in order to fulfil tax and accounting obligations, including transfer to the Polish National e-Invoicing System, if required by applicable law.

16. Out-of-court complaint handling and dispute resolution

  1. The Consumer may use out-of-court complaint handling and dispute resolution methods.
  2. The Consumer may in particular seek assistance from a municipal or district consumer ombudsman, consumer organisations or the Trade Inspection.
  3. Information on out-of-court complaint handling and dispute resolution methods is available, among others, on the website of the Polish Office of Competition and Consumer Protection.
  4. The use of out-of-court complaint handling and dispute resolution methods is voluntary.

17. Final provisions

  1. In matters not regulated by these Terms and Conditions, Polish law shall apply, in particular the Polish Civil Code, the Polish Consumer Rights Act and the Polish Act on the Provision of Electronic Services.
  2. These Terms and Conditions do not exclude or limit the rights of the Consumer and the Entrepreneur with consumer rights arising from mandatory provisions of law.
  3. The Seller may amend these Terms and Conditions for important reasons, in particular in the event of:
    • changes in law;
    • changes to the Seller’s data;
    • changes to payment or delivery methods;
    • changes in the functionality of the Shop;
    • the need to clarify the provisions of these Terms and Conditions;
    • changes to the rules for offering Personalised or Custom-made Products.
  4. Orders placed before the amendment of these Terms and Conditions shall be governed by the Terms and Conditions in force at the time the Order was placed, unless mandatory provisions of law provide otherwise.
